#492. What Can the US Learn from the Invasion of Israel by Hamas?

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US Entry #476 was the most recent “sense check.”

BEGIN ENTRY #492: What lesson(s) can the US learn from the invasion of Israel by Hamas? The answer is remarkably simple, yet I’ve heard little, if any, serious discussion about possible lessons.

Yes, I understand most of the news is focused on events of the here-and-now, as it probably should be. The news is also heavily weighted toward devastation in Israel and Gaza.  There’s also increasing coverage about the Catch 22 situation facing the Palestinians.  Israel has ordered an evacuation of the northern part of Gaza.  But Gaza is so densely populated, there is no place to flee other than Egypt and, as of now, that border remains closed.

Israel also faces a Catch 22 – how to eliminate leadership of Hamas in an environment where any serious military incursion will result in significant civilian casualties.

Why did Hamas invade southern Israel? The answer is multifaceted and covers numerous opportunities lost or squandered by both sides over many years.  Which side is to blame? It is easy to blame Hamas, and rightly so, for all the deaths of civilians, especially children.

Israel also shares some blame.  In a limited effort so far to eliminate Hamas leadership, Israel cut off food, water and medical supplies.  Combined with the shelling of buildings believed to house Hamas fighters, many Palestinians have been injured or killed. By the time Israel completes a sweep of Gaza, many more civilians are likely to die. The situation is a no-win for both Israel and the non-combatant Palestinians.

If one steps back from the current chaos and asks, “why all the destruction?”, the answer seems obvious, at least to me.  When a country or territory, such as Gaza, is run by religious zealots, decisions no longer are based on facts, or what is good for the general populace. Decisions become based on the dogma of the religious leaders.

Look at Iran prior to the 1979 Revolution. The Shah was no Mother Theresa, but the population was  highly educated, the economy reasonably strong. Since the 1979 Revolution Iran has been run by hard right religious zealots. What’s happened to innovation, creativity and the economy? Downhill.  Many really creative and ambitious people have left the country.

Same with Russia.  Under Putin, Russia has suffered a brain drain and more fled when Russia invaded Ukraine. A stark comparison of the effect of openness and dogma is Korea.  The South is robust and a major economic force.  The North borders on starvation.

What’s this have to do with Israel and Hamas?  Israel first.  In order to stay in power, and try to avoid jail time on corruption charges, Benjamin Netanyahu secured the most recent tenure as prime minister by cutting a deal with the hard right Ultra-orthodox.  (Sound familiar?  Mmm, maybe Trump taught Netanyahu or vice versa.) As a result of the deal, government policies and actions have become more religiously focused and less focused on Israel’s founding commitment to be a model democracy.

Hamas, like Hezbollah and the Palestinian Authority, is an “organization.”  In the early 2000’s, Hamas was elected by the people in Gaza to help transition Gaza to self-administration. Over the last 15+ years, Hamas has shifted from being a “governing body” helping run Gaza to focusing on try to annihilate Israel.

There’s much more of the story, but the lesson, for the US is this –  When the hard-right religious groups begin to control or heavily influence government decisions, the outcome is never good for the people and the country.

Over the last 30+ years, the Republicans have continued to shift to the right and court groups previously considered on the unacceptable outer edge. As the Party shifted, centrist Republicans lost control.  A recent high-profile example is the inability by Republicans to elect a Speaker of the House who is capable of getting legislation passed that can also be passed by the Senate, then signed by the president.

For centrist Republicans, the lesson from Hamas – fire the hard-right Freedom Caucus, or if that doesn’t work, or if you’re afraid to try, then cut a deal with Democrats to elect a Speaker than can get needed legislation moving again.

The lesson for US citizens  – keep in mind the US is not immune to what happened in Iran, Russia, North Korea, et al.  The US is not immune to conflicts like the one initiated by Hamas in Israel.  While the conflict might not be an invasion from Canada or Mexico, it could be another insurrection by the hard-right zealots – i.e., US Revolution V.  (Recall what happened in 1861?) #491. When Will Republicans Wake Up and Smell Donnie’s Doodoo?

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US Entry #476 was the most recent “sense check.”

BEGIN ENTRY #491: This entry might seem like a repeat or even a “three-peat.” But I’m stumped as to why anyone would continue to support Trump. Even if you dislike Democrats’ policies and/or dislike Biden, why support someone with a long history of fraud and deceit?

No, Trump’s fraud and deceit are not the garden variety type. We are talking about hundreds of millions of dollars over many decades and, most importantly, a serious attempt to overthrow the US government.

How much evidence do you need to realize Trump is a chump?  How can you think that all the Republicans who testified against Trump have somehow been corrupted by Democrats or an alien from outer space?

The list of Republicans starts at the top with a former Republican nominee for president and runs all the way to White House staffers.  The most recent source of information about Trump‘s bizarre and delusional behavior came from Cassidy Hutchinson, and aide to Mark Meadows, Trump‘s chief of staff. If you think Hutchinson was a nobody spouting off hearsay and lies because she couldn’t possibly know what was going on, well, think again.

Hutchinson held the same job – yes, the same job as Alexander Butterfield. Remember Butterfield? If you’re a Republican, you should. He was the person who answered “yes” to a question in a Senate hearing about Watergate.

The question? “Mr. Butterfield, are you aware of a recording device installed in the Oval Office?”  His straightforward reply of “yes” put the final nail in Nixon’s coffin.

Ms. Hutchison public testimony before the January 6 committee was enough to make anyone’s hair curl. Now more revelations are in a book about her time in the White House.

Lies you say. All made up!  Well, go search the public records for her testimony to the January 6 committee. She’s also testified before the Department of Justice and at least one grand jury.  Lying in any of the venues could result in a charge of perjury.

Further, match her track record for truthfulness against Trump’s. The match is not even close. She crosses the finish line before the Donald even starts the race.

Trump lied so much about his business in New York, and filed so many fraudulent documents that in a lawsuit brought by the NY AG, the presiding judge ordered a summary judgment against Trump and his organization, thereby eliminating the need for a jury trial to determine if he was guilty.  The ruling was sweeping and most likely will put Trump out of business in New York.  During the proceedings to determine damages, in which Trump waived his right to a jury trial, Trump made such threatening remarks about the judge’s staff that the judge issued a gag order.

Much more evidence about Trump‘s lying, cheating, stealing, and personal behavior is publicly available. If you need another credible evidence of this, look at remarks from General Mark Millie, former head of the joint chief of staff.  Also. General John Kelly, Trump’s former chief of staff.

So , ask yourself – is this the guy I want to be leading the country? The guy who has vowed to abandon the US Constitution and make himself dictator?

Also ask yourself, what if a Democrat exhibited the same behavior? Before you claim Clinton, and Obama were worse, go find some facts to prove your case.  You won’t find any.

If you still want Trump , then be prepared for an intense Civil War in the US. And, be prepared for what happened to the rebels in the south during the 1860’s. You’ll come out a loser. END ENTRY #491

#490 Republicans Redefined Definition of Conservative

16 Saturday Sep 2023

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US Entry #476 was the most recent “sense check.”

BEGIN ENTRY #490: While both US political parties do some thigs well and other times make bone-headed decisions, the “new” Republican Party led by Trump seems to continue taking bone-headed actions to a new level. What’s ironic is Party members claim they are “true conservatives.”

Has anyone inside the Republican Party, and especially the hard-right caucus, taken time to look up the definition of conservative? Likely not. Here’s a couple of short definitions, “tending to conserve or preserve,” “tending to preserve existing views, conditions, or institutions.” I guess the Jan 6 insurrectionists who stormed the Capitol thought being conservative meant being a rebel/traitor, as evidenced by their display of the Confederate battle flag.

Given the apparent commitment by Trump Republicans in the US House of Representative to refuse to make any effort at governing, I thought it was appropriate to offer a definition of ‘conservatives” that is more consistent with their behavior and Trump’s behavior.

C = Conceited, claiming only they, i.e., Trump Republicans, have the right answer
O = Obstinate, not willing to negotiate or even listen to anyone else’s ideas
N = Negligent, disregarding critical needs of the country and citizens – Sen Tuberville an example
S = Selfish, not willing to share anything other than with high-end donors
E = Egotistical, thinking their you-know-what doesn’t stink
R = Reactionary, claiming they are always the victim and never the cause of a problem
V = Vicious, attacking those trying to do their job for democracy
A = Arrogant, assuming only fellow Republicans of their ilk have the correct answer
T = Temperamental, acting like 2-year-olds when things don’t go their way. Orange Man throwing his lunch on the wall in the Oval Office is one of many examples.
I = Idiotic, as demonstrated by a wide range of crazy ideas, including trickle-down economics
V = Violent, claiming the Jan 6 insurrectionists were patriots and normal tourists
E = Evasive, refusing to answer basic questions about say sources of income – e.g., Clarence Thomas
S =Stupid, as demonstrated by continuing to deny global warming, buying into an array of laughable conspiracy theories and continuing to support Trump as a candidate, even though his criminal record has been well document for decades.

At one time, being a “conservative” Republican actually stood for certain policies and supported the Constitution. No longer. A conservative Republican now stands for nothing rationale and actively tries to disband the Constitution.

To be a viable democracy, the US needs two credible political parties. Two credible parties provide some guardrails to help rein in the occasional, but inevitable bone-headed proposals by one of the parties. The Republicans have abdicated their policies to the whims of an idiot.

The country has been making some progress toward reducing the severity of US Revolution V by using the legal system as it was designed – investigating, indicting where appropriate and then prosecuting criminals. If Republicans claim to be patriots, then “old guard” Republicans need to unzip their lips and start explaining to the voter base what needs to happen to rebuild the Republican Party and help avoid more bloodshed as the Revenge Revolution intensifies. END ENTRY #490

#489. Speak out? Why? The Guys in Charge Look Like Me.

BEGIN ENTRY#489: The last week of August 2023 included two markers in recent history of the US. One was the former president pleading “not guilty” (again) as part a RICO case brought in Fulton County Georgia.  Trump is the lead defendant in a case that centers on whether Trump and others attempted to overturn the results of the 2020 election.

The second marker was an event that happened 60 years ago – the March on Washington, DC.  The March included MLK’s famous speech, “I Have a Dream.”

What often is overlooked about the March is how many non-blacks participated.  In addition, what is rarely mentioned, and I confess I was unaware until very recently, is the person who spoke immediately before MLK – a German-born rabbi, who lived through World War II.

The focal point of the rabbi’s remarks seems as germane today as in 1963. He suggested the worst action anyone can take in a situation where people are being discriminated against or persecuted is to remain silent.  Without dwelling on the topic, the rabbi noted what happened to 6+ million Jews and others under German rule when people remained silent.

Non-Jews often wonder why Jews are so vocal at times. Why did Jews become an early supporter of the civil rights movement and participate in the marches where police brutalized participants?  What was in it for the Jews? What did they have to gain?

The answer is simple, nothing. But to remain silent would mean Jews were acting no better than most of the general population who remained silent in Germany, Austria, and Poland. Silence can be a de facto death sentence for those being oppressed.

OK, you’re thinking, cut the drama.  The March on Washington was 60 years ago, and Hitler came to power about 90 years ago. What does the “sound of silence“ have to do with today’s environment?

Go back to the beginning of this entry and reread the first marker.  Whether you want to believe it or not, Trump and his gang came perilously close to pulling off a coup and replacing POTUS with a dictator.

Everyone in the US should be shocked at the percentage of the population, and even more shocked at the percentage of the Republicans, who believe Trump: (i) is the subject of a witch-hunt: (ii) is a positive force (iii) should be reelected. Many of Trump’s supporters have similar profiles and are modern-day versions of the population in Axis countries who remained silent in World War II – white, and Christian.

How do people in this group justify being silent?  I’m baffled but I suspect many justify silence by thinking, “I am safe. No one is coming after me. Why should I get involved? Besides, I don’t like the way ‘those people’ look and act. ‘Those people’ are not like me.“

What’s your risk of not getting involved and remaining silent? You’ll be risking trading a democracy and all its protections for a dictatorship and its lack of protections. Ever think about what government provides in the way of benefits to you?  Ever think how easily those benefits could be eliminated with the stroke of a pen by a dictator?  (Libertarians should pay close attention to the list.)

Here are some examples. #1, ownership rights. If you think you own your house, your car, your stocks, or any other item, you need to think again. The government provides the right to ownership. The right to ownership is not in the constitution and not guaranteed without a functioning government.

#2, police and fire protection. What do you think would happen if police and fire protection were privatized?  Ever been exposed to “demand pricing” when buying an airline ticket?  How much do you think the cost of protection might increase if your house were on fire?

#3, public roads.  In a dictatorship, all roads could be privatized so you get to pay a toll to the dictator.

#4, the right to vote.  There would be no right to vote, or the elections would be rigged, much like Trump tried to do in 2020.

And this is the short list.  Still interested in supporting Trump and the gang?

If you think the list is “fake news,” then what the core tenets of your religion?  Please point out a religion that promotes watching other people suffer. Point out a religion where one is not supposed to help others.

If you still like Trump because you think that as a “member” of Trump’s club, you’re protected, think again.  Take a look at how all of Trump’s operations are run – he decides who’s a member and who’s not.  Don’t bow down to the Donald and get thrown under the bus.  In Donnie the Dictator’s world, one day you might find yourself on the outside. Then what have you got?  With the nod of a head, you can go from good to dead.

Now, go look in the mirror and ask yourself one more time.  “Is this the guy I want leading our country?” END ENTRY #489

#484: Why Not? My Kid’s a Legacy and I’ve Donated Lots of Money!

BEGIN ENTRY #484: Well, well, well. Wealthy Republicans are beginning to understand that decisions have consequences. Soon after toasting the SCOTUS decision to overturn precedent and ban affirmative action, the Republicans began to realize legacy admissions were now on the chopping block.

No doubt many of the elite schools will find a way around any likely ban on legacy admissions, much like many of those schools will find a way around the ban on affirmative action.

The ban on legacies is supposedly being pursued to ensure equitable admissions at these elite institutions, just like the SCOTUS decision. Ironically, those pushing for a ban on legacy admissions are not thinking about possible consequences just like those pushing to ban affirmative action failed to consider consequences.

Yes, legacy admissions are overwhelmingly from white, wealthy families. But, who do you think donates large chunks of money to the school’s endowment; who do you think helps fund new buildings; and who do you think helps subsidize tuition of students admitted under affirmative action?  Don’t think too long about it. The answer is the families seeking legacy admissions.

What is the “opportunity cost” of denying one legacy admission?  That one legacy admission can generate a significant positive long-term financial impact on the academic institution.  What’s the downside?  Virtually nothing since the legacy rarely goes into a high-profile public position – George W. Bush being an exception – and many of those admitted will go back into the family business or live off a trust fund.

Simple example. The brother of a grammar-school classmate of mine was admitted to a high-profile, smaller private college. The brother was at best marginally qualified.

Why was he admitted? The father agreed to fund construction of a new building on campus.

Those wanting to ban legacy admissions should do the math.  The result of admitting one marginally qualified student was a new building that benefited thousands of students over the life of the building.

Given the benefits derived from preference given to the legacy student, who is being harmed? By the way, the student ended up going back to the family business.

There’s a potential cascading effect of eliminating any preferential treatment. Where does one draw the line allowing the institution to favor certain students academically and not others?  If affirmative action is eliminated for academic admission and then legacy admissions, the next logical step is to eliminate preferential treatment for athletes.

Does anyone really think that 10 of the 12 members of the basketball team at say Duke University are   academically qualified? Same with athletes recruited for most high-profile football teams.

When the lawsuit is filed to eliminate preferential treatment for athletes, it will be fun to watch the Supreme Court use their pretzel logic to justify why sports admissions should be excluded while affirmative action and legacies are not. It will be even more fun to watch members of Congress react when they realize that athletic admissions to their favorite university have been changed. END ENTRY #484

#483. SCOTUS Plan: Bomb Brown; Promote Plessy.

BEGIN ENTRY #483:: Some key decisions at the end of the 2022–23 term for SCOTUS were less surprising than the rationale justifying the decision. Three key decisions in particular seem to be laying the groundwork for the next opportunity to address the race issue.

Overturning affirmative action in college admissions was expected by a court that overturned Roe. The decision that negated President Biden’s Executive Order to waive a portion of student debt was another example of the Roberts’ Court stripping the authority of the executive branch that had been granted by Congress.  Another decision was allowing religious beliefs to justify being able to discriminate against another individual or group.

Lots of ink this week and likely more next week about the impact of the affirmative action decision on college admissions, efforts by companies to diversify the workforce, etc.

While the SCOTUS ruling effectively banned affirmative action, there was one notable exemption. Without any justification, the opinion written by Chief Justice Roberts excluded the military academies from the decision, allowing the academies to use race in selecting candidates for admission.

Why are military academies so different from Harvard, University of North Carolina, and other academic institutions? No explanation offered. But, maybe, just maybe, the service academies want the officer corps to reflect the composition of enlisted personnel. Like many claims made by conservative Republicans, no supporting data or explanation was offered.

Where do these decisions lead? In 2010, the Roberts’ Court gave corporations more rights than individual citizens in the Citizens United case. In 2013, the Roberts’ Court ruling in the Shelby Country case gutted key provision of the Voting Rights Act, allowing states to essentially restrict voting rights, especially for people of color. In 2022 to the Roberts’ Court stripped women of any rights over their bodies in overturning Roe.

See a pattern here? There are more examples of the Roberts’ Court taking away rights rather than granting rights.

What’s the next target for the Roberts’ Court?  My bet is overturning the 1954 case of Brown v Board of Education. Overturning Brown would allow SCOTUS to reinstate Plessy v Ferguson, which established justification for having “separate but equal” facilities in transportation, education et al.

Think overturning Brown is unrealistic?  Read the language of opinions by Roberts and Thomas in the affirmative action cases.  Frequent reference to the “equal protection” clause in the 14th Amendment claiming that the clause prevents one segment of society from being favored over another. Since Republican appointees to SCOTUS often claim to be originalists, maybe they should consider why the 14th Amendment was written.

The 14th Amendment was passed by Congress in 1866 and ratified in 1868.  I guess Roberts and the originalist gang failed history in high school or conveniently forgot the 14th Amendment was passed to protect blacks following the Civil War.  Was Roberts thinking, “Never mind history.  I need to make this decision seem rational, no matter how illogical.”

By the standards of the Roberts’ gang,  Brown effectively favors blacks by forcing the busing of children to white schools.  Brown also discriminates against whites by being bussed to what often are or were predominately black schools.  Brown discriminates against both groups by taking away rights to attend neighborhood schools.

Thus, Brown is effectively an affirmative action program for blacks, which SCOTUS ruled as unfair.  Therefore, to ensure there is no discrimination against any citizen, the only solution is to reinstate Plessy.  Reinstating a “separate-but-equal“ school system is a fair and equitable solution that allows children to attend neighborhood schools.

Reinstating Plessy seems far-fetched? No, I’ll bet the far right is preparing to file, if not having already done so, a challenge to Broun. The challenge likely will be filed in the 5th Circuit, which includes Louisiana, Mississippi and Texas, and is packed with far-right judges. These judges then will allow the case to go forward to the Supreme Court.

What is the cumulative effect of the last decade of SCOTUS decisions?  Will the decisions affect the likelihood of a more intense 5th US Revolution, the Revenge Revolution? Constantly taking away individual rights – women’s right to choose, voting rights of non-white groups, equal protection of LBGTQ community, etc. – creates frustration and anger.  Women are angry about overturning Roe. While the affirmative action decision is less controversial than Roe, for those affected, the frustration may be comparable.

SCOTUS decisions that seem heavily weighted toward favoring a Republican base of white Christians, mostly men, plus the continued drip, drip of corruption of behavior by Thomas, Alito, and even Roberts, are intensifying the frustration.  There’s a saying I saw on an apron that seems to sum up the long-term problem for SCOTUS and Republicans – “When mama ain’t happy, ain’t nobody happy.”

As we approach July 4th, 2023, mama and many others ain’t happy.  And what Republicans and far-right SCOTUS justices seem to have overlooked, is their bizarre interpretation of the 2nd Amendment has resulted in widespread ownership of firearms among the frustrated majority.  These actions increase the likelihood of a more intense Revenge Revolution, which has already started but not yet boiled over.

#482.  SCOTUS Scums. Throw the Bums Out!

BEGIN ENTRY #482: You don’t need to think about this issue for very long. Why do certain SCOTUS justices think the law and/or ethics rules do not apply to them?

And which SCOTUS justices squawk the most about the importance of ethical behavior?  Yes, the same SCOTUS scum justices who flagrantly ignore any standard of ethical behavior.

The SCOTUS scum-justices are undermining the credibility of the Court.  The flagrant disregard of basic ethical and moral standards by certain justices is no surprise to anyone who regularly follows Supreme Court decisions and how each justice votes. To paraphrase Shakespeare, “Methinks certain Supreme Court Justices doth protest too much.”

The ethics of Clarence Thomas have always been in question. Thomas, aka Porno Man, never should have been approved by the Senate Judiciary Committee – shame on you then Senator and committee chairman Joe Biden – let alone confirmed by the entire Senate. Thomas was the token black proposed by Republicans to replace the legendary Thurgood Marshall. Who knows how much money Thomas was paid upfront to agree to keep his mouth shut, and always vote with conservatives. We know he’s been paid regularly since joining the court. We just don’t know how much.

Samuel Alito, the holier-than-thou justice, vigorously denied that his all-expenses paid sojourn to Alaska with a billionaire had any influence on his decision on the numerous cases before the court in which the billion’s company was involved.   Alito mounted his defense of the sojourn and failure to report it by opining an op-ed piece in the Wall Street Journal.  The op-ed piece was published before the release of the article by ProPublica, which had sent him a courtesy copy to review.  The defense by Sinning Sam Alito was laughable by any standard.

Anyone who has studied human behavior knows that past behavior is a good predictor of future behavior. If Alito is prone to preempt publication of articles,  I wonder who leaked the decision in the Dobbs case that overturned Roe – and who wrote the majority opinion?  Oh, yes, Alito – and who might have leaked the decision in the Citizens United case?

The source of leaks never has been investigated adequately. A good first step by the Chief Justice would be to approve a 3rd party professional – FBI or Federal prosecutor – to conduct a series of serious and professional interviews, starting with Alito.

While we’re on the subject of Roberts, his unethical behavior is not as blatant as either Thomas or Alito. However, Roberts as chief justice has an obligation to the country to rein in justices who do not follow the rules re reporting and recusal.  I can only imagine the uproar from Republicans if one of the more liberal justices had exhibited behavior 1/10 as egregious as either Thomas or Alito.

Roberts term  as chief justice will go down as possibly the worst since the beginning of the 20th century. While some decisions were questionable, the real problem for the Roberts court is the behavior of some justices. This behavior has contributed to a precipitous and sustained decline in the US public’s confidence in the Supreme Court. Roberts, it’s time to start a turnaround program and rebuild public confidence.  A good first step would be getting the two SCOTUS scums off the bench. END #482

#477. Dominion’s Dumb Decision Damages Democracy

22 Saturday Apr 2023

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US Entry #476 was the most recent “sense check.”

BEGIN ENTRY #477: A few days ago, Dominion Voting Systems agreed to an out-of-court settlement with Fox News. News Corporation, Fox’s parent, agreed to pay Dominion $787 million as part of the settlement for a libel suit brought by Dominion.  In addition, Fox had to admit, somewhat tepidly, that it had made false statements, aka lies, on the air about the credibility of Dominion’s voting machines.

By settling out of court, Fox avoided having testify in court CEO, Rupert Murdoch, and several high-profile talking heads.  Dominion had evidence that would have forced Murdoch and the talking heads to admit they lied on the air about Dominion as well as lied about the credibility of Trump’s claims the 2020 election was somehow “stolen.”

Following the announcement settlement, a number of lawyers, particularly on cable, began slobbering all over themselves about the unprecedented amount of payment and that other portions of the settlement would put guardrails on Fox’s behavior.

My view? Fox was the winner, not the loser.  Dominion was the loser. While the $787 million settlement was unprecedented for a libel case, the $787 million represents a minor hiccup to Fox’s earning stream.  Fox will still have a profit for FY2023 and possibly a profit for the quarter in which the settlement is booked. In addition, Fox is likely to slightly increase 30-second ad rates to cover the expense.

The settlement will have virtually no effect on Fox’s audience.  Fox viewers are likely to remain loyal.  Most will discount any terms of the settlement and many viewers may be unaware of most of the terms, given the limited coverage on Fox.

As far as the settlement controlling lies by Fox’s talking heads – Carlson, Hannity et al – don’t count on it. The Fox staff will train the talking heads to reframe lies as questions or claim in the commentary that they are merely “reporting” on what others have said.

The likelihood of Fox encountering another successful libel suit is very small.  The threshold for such suits is very high and Dominion was lucky to have had access to a trove of emails, texts and voice recordings proving Fox was lying.  As such, there is no incentive for Fox to change. Per chance, if Fox is facing another lawsuit, bring out the checkbook and buy your way out.

Why did Dominion settle?  By not settling, Dominion could have increased its market share.  Granted, no “self-respecting” election official in a Republican-dominated district would ever buy a Dominion voting machine.  I suspect many Republican-dominated state legislators will introduce legislation to ban any district in the state from purchasing Dominion voting machines.  If the Donald says “no” then the legislators must say “no.”

By not settling, Dominion could have gained market share in more Democratically controlled states. Officials in those states could have leaned toward Dominion’s system because the system is credible, and Dominion stood up to Fox and Trump.  Now those officials have less incentive to support Dominion.  For many of those officials, Dominion’s decision to grab the money and effectively cave into Fox is a reason not to buy Dominion machines.

So, one more time, why did Dominion settle when they had Fox by the short hairs?  Even the presiding judge said Fox was not credible.  Oh, yes, follow the money.  The decision by Dominion may not have been made by Dominion executives, but guess who?  Yes, you guessed right – the paragons of ethical behavior.  A private equity firm that purchased a portion of Dominion a few years ago.

So, in the end,  the private equity firm’s greed forced Dominion management to push aside ethics and principles. While the PE firm got cash and a huge ROI multiple for caving to Fox, the public got nothing. Fox bought its way out on the cheap and also bought the right to continue distorting the truth with no guardrails and little fear of repercussion.  Another dagger in the heart of democracy.

As for the future of Dominion, the PE firm will take the money and run, leaving Dominion a wounded player.  Let’s hope Dominion recovers.  However, don’t be surprised if in the next couple of years Dominion Voting Systems declares Cha11 bankruptcy or ends up being purchased by another company.  In the meantime, the members of the private equity firm will probably be watching Fox News.

#473 Is Black History Month Perpetuating Discrimination?

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US. Entry #430 was the most recent “sense check.”

BEGIN ENTRY #473: For the past few years, I’ve been troubled by the following question. ”Is designating a month, February, as special for studying a particular race, in this case blacks, helping reduce discrimination or inadvertently perpetuating discrimination?“ Today is President Lincoln’s birthday, which seems an appropriate day to raise the question and provide some boundaries for the discussion.

The dilemma, at least from my perspective, seems to arise from what I think is a long-standing goal within the black community – assimilation. Assimilation in the sense of recognition as equals, not assimilation by eliminating blacks as a race.

The original intent of Black History Month seems noble – make US citizens more aware of accomplishments by blacks in the arts, science, humanities, and other areas. And the month seems to address some of those accomplishments.

The month also, intentionally or not, seems filled with articles and claims of “woe is me.”  Articles and commentary that delve into past discrimination, what’s wrong with society today, why blacks are being denied this or denied that.

Granted, I have not spent an immense amount of time digging deep into all the conversations. However, what seems to be missing from these conversations now – and over at least the last 10 years – is an honest, discussion by blacks of how they intend to help solve the problem.  What are blacks going to do to improve their own lot?

And the answer is not more busing to different schools.  More busing per se will not improve the education level for most blacks. Education requires a commitment to learn, not just getting on a bus and riding to a different school.

And the answer is not more black coaches in the National Football League.  What more black coaches or black quarterbacks in the NFL have to do with improving the economic well-being of blacks in general is beyond me. And even more of a waste of time is whining when a black coach gets fired.  Outside of a handful of coaches in NFL history, all coaches are fired at some point.

I’ve made this observation in the past blog entries, but it seems worth repeating.  And the observation seems so basic. If every other ethnic group entering the US has managed to become assimilated in two generations – three at the most – why haven’t blacks?

All other ethnic groups were discriminated against and, some still are.  If you don’t think so, read some history of the early 20th Century and then some stories of discrimination of these groups as recently as last week. Do you hear any of these ethnic groups whining about discrimination? Not that I know of.

What has been the formula for these groups? A commitment to education. Not a commitment to football or basketball or the music. No, a widespread to commitment to general education. Where did that start? At the very local level, ideally with the family.

So why aren’t blacks leaders learning from these other ethnic groups and pushing for education starting at the family level? Ignore Ron DeSantis and his efforts in Florida to remove an advanced placement course in black history. Expending any effort on DeSantis is a waste of time because what he says might be annoying, but it cannot stop a legitimate effort to improve.

Instead, think about how to get children and young adults focused on education.  The education doesn’t have to be in college – skilled trades are needed and offer good paying jobs. And while you’re focusing on education, ask Congress to rename Black History Month to Black Education Month.  Focusing the conversation and efforts on education will pay dividends for members of the black community and gain much more support from the rest of society. #472. Is There a Black Elephant in the Room?

Welcome to a discussion about the upcoming 5th Revolution in the US, which I’ve titled the “Revenge Revolution.” For more about the Revenge Revolution and the author, Entry #1.  Periodically I write a “sense check” to assess whether a revolution in the US is possible or whether the entire exercise is based on a statistical aberration — i.e., a roughly 50-year cycle between major upheavals in the US. Entry #430 was the most recent “sense check.”

BEGIN ENTRY #472: The beating and eventual death of Tyre Nichols by Memphis police was a tragedy. Nothing about the police behavior seems rational.

Since Mr. Nichols death numerous people have expressed outrage, and rightfully so. My question is where should the outrage be directed?  Change is obviously needed, but where should we start?

In previous deaths by police of seemingly innocent black men, George Floyd, for example, the rage, especially in the black community, was directed at white police officers. The solution, many suggested, was more diversity throughout the police force, from senior officers to cops on the beat.

Such suggestions seemed perfectly rational. More black officers would better understand issues affecting the black community. More black officers also would help white officers better understand the issues.

The City of Memphis adopted many of these recommendations. Memphis installed a black, female chief of police and hired a substantial number of black police officers.

So, who was directly involved with the beating of Mr. Nichols? Black police officers. Not one or two officers, but five black officers.

When the inevitable blame game started, who did the “talking heads” in the black community cite as the cause of Mr. Nichols death? The cause was not the five black officers, who were later terminated, but the cause was always something else.  Causes cited ranged from systematic racism by the police force, even though those directly involved were black, to the “boys in blue” are always unfair to the black community, even if the boys in blue are black, to as one high-profile columnist wrote, “America has failed the black community again.”

Huh?  Explain this to me, please.  Five black officers were part of a special unit established by the black chief of police to address excessive crime in a predominantly black area of Memphis. Part of that area is where Mr. McNichols lived. One the problems the special unit was to address included excessive speed on neighborhood streets. The police officers were directed to get tough on violators.

Well, based on the police videos taken when Mr. Nichols was pulled over, the police were way out of line given the possible infraction.  So, rather than automatically blaming someone, some system or some systemic attitude for Mr. Nichols death, maybe it’s time to look in the mirror and ask, “what’s the real problem here? Is there a black elephant in the room we don’t want to talk about? How much of that problem is being caused or being aggravated by members of the black community?”

The City of Memphis seems to have done virtually all of what black leaders previously asked of the police departments. More black managers, and more black officers. From all the evidence, Mr. Nichols did nothing outlandishly wrong, and did not resist. Yet five, yes five black officers savagely beat him. Does a blue uniform make one automatically racist? I think not, although to be fair I talked to a long-time black friend today who claimed the white police trained the black officers to be racist.  I let that comment slide and went on with the conversation.

Maybe it’s time to quit blaming others for many of the problems in the black community and for blacks to start taking more responsibility for making changes.  One thing is for certain.  Continuing to blame others for seemingly every ill in the black community is a surefire way to end up losing support of many outside the community trying to help. END ENTRY #472
